By accessing or using SwahiliCard's website, mobile application, or any services provided by SwahiliCard (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
We reserve the right to modify these Terms at any time. We will provide notice of any material changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.
To use certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
The Service allows you to create and share digital business cards and other content ("User Content"). You retain all rights to your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such User Content for the purpose of providing and promoting the Service.
You are solely responsible for your User Content and represent that you have all necessary rights to share it. You agree not to post User Content that:
Some features of the Service may require a subscription or payment. By subscribing to such features, you agree to pay all fees and charges associated with your account on a timely basis.
Unless otherwise stated, all fees are quoted in US Dollars. We reserve the right to change our pricing at any time, and such changes will be effective upon posting to the Service or notification by email.
The Service and its original content, features, and functionality are owned by SwahiliCard and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service or third parties, or for any other reason.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SWAHILICARD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
These Terms shall be governed by the laws of Kenya, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Kenya.
